Fit For Life Policies for Members

Julie Green Enterprises, LLC, DBA Fit For Life will be referred to as FFL throughout this document.
All members must adhere to all policies at all times with no exceptions. Members are not allowed to modify or omit any policies prior to or after signing membership agreement.

*Signatures required: All members must complete a membership application form in its entirety, including all signatures and initials prior to obtaining a membership. Members may not modify or omit any of the statements, information, or policies on the membership application. Members that are included in accounts with multiple members, including couple and family memberships, must each complete an application. This includes all children and the necessary parental consent forms. All forms must be completed prior to activation of membership. FFL assumes no liability for applicants failure to read all release, EFT, and other statements prior to signing. FFL reserves the right to modify all statements without notice.

*Proper identification is required for membership. All members are required to provide proper ID in order to obtain a membership. Members must complete membership forms fully to the satisfaction of FFL before obtaining a membership. FFL reserves the right to deny membership to anyone. FFL reserves the right to see proper ID , proof of age, marital status, and address at any time without notice.

*Membership types: FFL offers single, couple, and family memberships. Couple memberships are offered to legally wed spouses only. Family memberships are offered to legally wed spouses and all children 18 years old and younger residing at same address (Adults must be legal guardian(s) of children). FFL reserves the right to determine eligibility of all applicants for membership. FFL reserves the right to demand proof of marital status, proof of residence, and proof of age for all applicants. FFL reserves the right to alter membership types, requirements, and forms without notice.

*FFL offers excellent prices on products and services. Members may request special order items, and FFL will strive to obtain those items at the best price. FFL matches competing prices whenever possible. Persons using any products or services are doing so at their own risk. FFL assumes no liability for use of any product or services. All persons are encouraged to consult their own physician before using any product or service. FFL reserves the right to refuse sales or service to anyone for any reason without notice. FFL reserves the right to change services, products, and prices without notice.

*Payment for membership is due in full by the first day of each month. Members may have a grace period until the fifth day of the month. After the fifth of the month, any member that has yet to pay for the month will be considered inactive and will be denied access. A $10 reactivation fee will be applied to payments made after the 5th of the month. Additionally a $5 processing charge will be applied to any accounts with insufficient funds. Any bank fees for insufficient funds will also be applied. ISF fees have no expiration and will remain on account until paid in full. FFL reserves the right to change fees and dates without notice.

*No contracts: FFL does not require membership contracts. All memberships are on a month-to month basis. Any member that becomes inactive for any reason, upon returning, will be required to pay a $10 reactivation fee. For EFT accounts, members must give us notice, in writing, at least two weeks prior to the first of the month of any changes to EFT including canceling EFT

*No Refunds: FFL does not offer refunds for memberships or other services for any reason, including non-use and unavailability of equipment, classes, or any/all areas of facility. In the event a member’s physician instructs the member to stop working out for a period of time, the managing partners will review the case. The request for review must be submitted in writing to be considered.

*New members have 7 days from signing up to review the following policies in full. Prior to the end of the 7 days, should a new member decide they do not wish to comply with any of the policies, they may cancel their membership. The member will be refunded fees paid at sign up less the expired days. After 7 days from initial sign up, the member will be expected to follow cancellation policies listed below with no refund offered.

*Membership must be current. In order to access our facility, all members must have current memberships in good standing prior to entering the facility. This includes timely payment of membership and any outstanding fees, adherence to all policies, and completion of all required forms. FFL reserves the right to request proof of identity and presentation of access card at any time. FFL reserves the right to refuse admittance to anyone. Anyone entering the facility without a current membership in good standing will be considered trespassing and may have membership denied permanently and/or authorities contacted.

* FFL does not guarantee access at any time. Some members in violation of policies may lose their 24-hour privileges without further notice. Members may also experience periods where access to the facility is delayed due to faulty equipment, weather, staffing issues, maintenance issues, and other reasons, without notice, as deemed necessary by FFL. FFL reserves the right to deny access for any reason at any time without notice.

*Everyone must check in when entering the facility. All members must use their individual access cards to obtain access at the door. No member may tailgate another member when entering the facility during non-staffed hours. Each member must wait for the door to close and then access the door with their own card. During staffed hours, members may enter the door without using an access card but must use their access card at the customer service desk before proceeding. Any member wishing to gain access without their own access card may only do so during staffed hours and by following check-in procedures. Members without their access card must stop by customer service desk and present proper ID and be manually checked in by FFL staff prior to using the facility. FFL reserves the right to enforce the use of access cards, including requiring members to purchase replacement cards.

*Visitors are welcome during staffed hours only. All visitors must check in at the customer service desk prior to working out. Visitors must present proper identification and complete our registration process, including completing a tour of our facility. Visitors must pay prior to working out. Once registration is complete, visitors may have access to the entire facility and classes during that day. FFL reserves the right to refuse admittance to anyone for any reason. FFL reserves the right to change visitor policies and prices without notice.

*Do not allow anyone in the gym. Everyone must enter by using their own access card. This includes those listed on your account. If a person is unable to enter via their own access card, they must obtain assistance from our customer service team in order to enter the facility. If unable to gain access during non-staffed hours, the person must leave and return during staffed hours. Anyone entering the facility without a current membership in good standing will be considered to be trespassing and may have charges filed. Anyone assisting a non-member with gaining access will lose 24-hour privileges and may have membership terminated. FFL reserves the right to refuse access.

*No children allowed during non-staffed hours. Anyone under the age of 18 may only use the facility during posted staffed hours of Monday-Friday 8:00am-8:00pm and Saturday 9:00am-3:00pm. This includes members 14-17 with their own access card and children 0-17 years of age accompanied by a parent. Anyone under 18 entering facility during non-staffed hours will have membership terminated and parent/legal guardian may also lose 24-hour access, and termination of membership is possible.

*Playroom is available during staffed hours. Please keep children safe and away from free weights, cardio, circuit, classroom, boxing area, etc. at all times. Please refer to age specific policies listed below. FFL reserves the right to demand proof of age at any time. Persons using any products or services are doing so at own risk. FFL assumes no liability for use of any product or services.

*Parking: FFL does not own any parking. All parking is owned by the City of Bay City. FFL assumes no liability and is not responsible for any issues involving parking. All parking concerns should be addressed to the City of Bay City. FFL encourages the use of public parking and does not encourage any parking on private property. FFL encourages members not to park directly in front of other businesses or residences. Bicycles, skateboards, inline skates, and any other mode of transportation is not allowed inside FFL. FFL provides a bike rack for bicycle parking only. FFL assumes no liability for any issues associated with use of the bike rack. It is a violation of city ordinances to park any motor vehicle, including motorcycles, on sidewalks. FFL will contact city police and report any violations observed.

*Video surveillance : FFL utilizes surveillance cameras 24 hours, seven days a week. These cameras are not to be relied upon for emergencies or security. In the event of an emergency or security concern, persons should call 911. FFL reserves the right to remotely monitor and record all areas, persons, and activities within the property owned by Julie Green Enterprises, LLC. FFL further reserves the right to use these video recordings and live feeds for any reason without notice to persons involved.

*All classes are included in memberships. Classes will take place at scheduled times as determined by FFL and as posted. Classes are for current members in good standing. Unless otherwise posted, classes are for members 14 years of age and older. All classes are open to all members regardless of age, sex, etc. Classes are first come, first serve. FFL reserves the right to determine capacity of all classes. FFL reserves the right to alter or cancel a class for any reason up to 15 minutes after scheduled start time without notice. Persons participating are doing so at their own risk. FFL assumes no liability for use of any product or services. All persons are encouraged to consult their own physician before using any product or service.

*Limited access. Some areas of the facility including, but not limited to, behind the customer service desk, storage rooms, closets, maintenance rooms, etc. are off limits to members at all times and are for staff use only. Attempting to enter these areas may result in immediate termination of membership and having charges filed. Other areas including, but not limited to, the pool, classroom, climbing wall, and playroom are only available to members during scheduled hours. Entering these areas during non-scheduled hours without permission may result in loss of 24- hour access, termination of membership, and charges being filed. Areas such as tanning and the personal training room are only available for an additional fee and with proper documentation and supervision. Entering these areas without permission may result in loss of 24 hour access, termination of membership, and/or charges being filed. All areas are to be used for intended purposes only. No member may monopolize any area at any time. Improper use of any area will not be tolerated. FFL reserves the right to define appropriate use. Attempting to gain access to any area with force will result in immediate termination of membership and/or charges being filed. FFL reserves the right to deny access to any area without notice.

*Tanning is offered at FFL. FFL adheres to all local, state, and federal laws regarding tanning. Customers must wait at least 24 hours between tanning sessions. Customers must follow all rules and observe all posted warnings when tanning. Customers must complete all required documentation prior to tanning. No one under 18 years of age may tan at FFL. Persons using tanning equipment are doing so at their own risk. FFL assumes no liability for use of tanning products or equipment. FFL reserves the right to refuse tanning to anyone. FFL reserves the right to change tanning options, prices, and availability without notice.

*Pool use is limited. The pool is available during staffed hours only. Members 18 years of age and older may use the pool for lap swimming for a maximum of 30 minutes if another member is waiting. Members 9 -17 years of age may use the pool with immediate and constant parental supervision. Members under 9 years of age may not use the pool. Members are using the pool at their own risk. No lifeguard is on duty. FFL assumes no liability for use of the pool. FFL reserves the right to deny access to the pool for any reason at any time without notice.

*Lockers are available. Daily use lockers are available free of charge and on a first come, first serve basis. Personal items are not to be left in daily use lockers overnight. FFL is not responsible for lost, stolen, or damaged personal items stored in lockers. FFL recommends members use their personal locks to secure lockers. FFL reserves the right to gain access to any locker, including removing personal locks without notice.

*Lockers are available for monthly rental at $5 per month and on a first come, first serve basis. FFL is not responsible for lost, stolen, or damaged personal items stored in lockers. FFL reserves the right to retain a copy of the key for any locker, change the lock on, and the right to gain access to any locker without notice.

*FFL provides locations to temporarily store personal items, such as keys. FFL is not responsible for lost, stolen, or damaged personal items. FFL staff will not accept responsibility for any personal item or guaranty said items protection from loss or damage. Any personal items left at FFL will be kept for a minimum of two weeks. After two weeks, any unclaimed items will be donated to a local charity. FFL is not responsible for loss or damage of any personal item left in our facility.

*Equipment maintenance is performed by FFL. Members are not to attempt any repairs, alterations, or relocation of any equipment at any time. Tampering with or otherwise attempting to repair or make alterations to any equipment will result in loss of 24-hour access, possible termination of membership and/or charges being filed. FFL does not guarantee the availability of any equipment. FFL reserves the right to discontinue the use of any equipment for any reason, without notice. Members are to use equipment as designed, for the purpose intended by manufacturer and in the location and manner approved by FFL. Improper use, including but not limited to: altering design or function of equipment, performing exercises other than those for which equipment is designed, adding or removing weight, cables, bands, pads, rope, chain, etc. on equipment, performing exercises with improper form, relocating equipment, etc. will not be allowed. Additionally, boxing equipment is to be used solely for the purposes approved by FFL. No weapons, sticks, bows, clubs, etc. are to be used to strike boxing equipment. Such improper use is considered unsafe and violates FFL policies. Hanging, tying, or any other form of attaching ropes, chains, bands, cables, bars, etc. to any equipment, surfaces, roof, walls, etc. is not allowed. Anyone violating this policy will immediately lose 24-hour access, may be limited to use of equipment, and/or may have membership terminated. FFL reserves the right to determine proper use. Persons using any products or services are doing so at their own risk. FFL assumes no liability for use of any equipment. All persons are encouraged to acquire necessary training prior to using any equipment and to consult their own physician before using any equipment. The use of equipment not provided by FFL is prohibited. FFL assumes no liability for the use of any equipment including personal equipment provided and used by members, staff, instructors, or personal trainers.

*All personal training must be pre-approved by Julie Green Enterprises, LLC DBA Fit For Life. According to our policies, and in compliance with our insurance policy, any training session, whether official or unofficial, including any sessions that may be perceived as personal training sessions must be authorized by Julie Green Enterprises, LLC DBA Fit For Life. All such sessions must be arranged, assigned, and compensated by Julie Green Enterprises, LLC DBA Fit For Life. FFL reserves the right to define personal training session. All persons interested in being trained in our facility must be members in good standing. These members must present a request for training directly to Fit For Life’s customer service team. Once the session has been assigned, the member must pay prior to any and all sessions. Anyone interested in training in our facility must also be a member in good standing with Fit For Life. Persons interested in training must interview, present qualifications, and be approved to train in our facility prior to any training occurring. Should you be interested in training at Fit For Life, you may contact Julie Green for an interview. Anyone violating this policy will lose their 24-hour privileges and may have their membership terminated. The persons involved may also be billed for services by FFL. Persons using any products or services are doing so at their own risk. FFL assumes no liability for use of any product or services. All persons are encouraged to consult their own physician before using any product or service.


 
*All activities must be approved by FFL in advance. Activities including, but not limited to the following, are not allowed: any person to person contact sport such as boxing, sparring, wrestling, kickboxing, hand to hand combat, self-defense, weapons training, or any form of martial arts; activities incorporating weapons such as fencing, numchucks, sticks, bows, bats, clubs, ropes, etc.; gymnastics, obstacle course training, scuba diving, surfing, unapproved Crossfit-type training, unapproved Strong man-type training, unapproved group training, unapproved instructional activities, etc. are not allowed. Anyone participating in such activities or any other unapproved activities will immediately lose 24-hour access, may have membership terminated, and/or may have charges filed. FFL reserves the right to determine approved activities. Persons using any products or services are doing so at own risk. FFL assumes no liability for use of any product or services or participation in any activity. All persons are encouraged to consult their own physician before using any product or service or participating in any activity.
     

*Solicitation is not allowed in FFL. No person may solicit anyone in our facility at any time for any reason. Advertisements, flyers, business cards, etc. may not be posted or passed at any time. FFL does not allow persons associated with any group that is in direct competition with FFL and any of our services or products to obtain a membership. Any person found to be in violation of this policy after obtaining a membership will have their membership terminated immediately. This includes, but is not limited to, persons leading fitness-related classes and/or personal
trainers, as well as persons selling supplements, fitness apparel, fitness accessories, etc.. Businesses, including not-for-profit, governmental, educational, and religious, that support and encourage direct competition with FFL may also be denied membership. Additionally, those
employed by said persons or businesses will also be denied membership. FFL reserves the right to define whether a person is in direct competition.
FFL reserves the right to refuse membership and services to anyone for any reason.


*Do not drop weights. Dropping weights even slightly will eventually break them. Dropping weights, not re-racking, and using equipment inappropriately is a direct violation of polices. This includes but is not limited to dumbbells, barbells, plates, cable machine weight stacks, attachments, bars, etc. Please ask a fellow member or staff to assist you if you feel unable to complete your set without dropping the weights.
Your belief that you are “going heavy” does not exclude you from this policy. Any member violating this policy may lose 24-hour access and may have membership terminated. FFL reserves the right to determine if a member is using the equipment properly and deny use of any equipment without notice.


*Re-rack equipment. Members are required to place any item used back in its designated location prior to leaving any area of the facility. This includes, but is not limited to, cable attachments, belts, plates, bars, collars, benches, steps, balls, boxing equipment, bikes, mats, fans, and dumbbells. Failure to re-rack may result in a member losing the privilege of using the equipment, loss of 24-hour access, and/or termination of membership.


*Share equipment and space.
No member may monopolize any equipment or area of the facility. This includes, but is not limited to, plates, bars, dumbbells, benches, machines, attachments, sauna, pool, boxing equipment, etc. Allow other members to use equipment during your rest
periods. Members may not use the equipment to rest or loiter. FFL reserves the right to use any of the equipment and space at any time for classes, personal training, instruction, maintenance, cleaning, etc., without notice.

*Wear appropriate attire. Shirts, shorts/pants and shoes must be worn at all times. Men are allowed to use the pool without shirts, and shoes are not required while in the pool area. Members tanning in our facility may tan without clothing provided clothing, including shoes, is worn to and from tanning rooms. No jeans or other clothing with rivets may be worn when using any equipment that has upholstering. This includes, but is not limited to, jeans, jean shorts, overalls, coveralls, clothing with large buckles, snaps, exposed zippers, chains, etc. The material and rivets tear the
upholstery. No hard-soled boots allowed. No muddy shoes or clothing allowed. No flip flops, sandals, or other open-toe shoes allowed. This includes, but is not limited to, work boots, rubber boots, cowboy boots, hiking boots, cleats, dress shoes, wheeled footwear, etc. Clothing with racist, sexist, religiously-biased, vulgar or any other potentially offensive graphics will not be tolerated. Athletic attire is permitted. Any attire that exposes or has the potential to expose, whether intentional or unintentional, genitalia, breasts, or buttocks is not permitted. FFL reserves the right to determine definitions of appropriate attire.

*Maintain proper hygiene. To help prevent the spread of germs and bacteria and for the general comfort and safety of all our members, FFL requires that all members wear clean clothing and observe proper hygiene. This includes, but is not limited to, regular bathing with soap and water,
use of personal deodorant, and regular washing of clothing. Any excessive odors, including but not limited to, those caused by poor hygiene, illness, smoking, work environment and clothing will not be tolerated. FFL reserves the right to define proper hygiene.

*Keep food in designated areas. Liquids in closed plastic or metal containers may be used in the areas of free weights, cardio, circuits, class, boxing area, etc. These liquids are limited to water, pre-workout or energy drinks, and sports re-hydration drinks. Alcoholic beverages are never
permitted in the facility. Food, including bars, chips, and other snacks sold in the facility must be kept in the areas immediately surrounding the customer service desk and water fountains. Meals, including but not limited to, fast foods, take-out, prepared meals requiring utensils, etc. are not permitted.

*Smoking is not permitted in the facility or within 50 feet of facility doors.


*Drug use or any appearance of being under the influence of drugs will result in immediate termination of membership and notification of law enforcement.


*Alcohol is not permitted in the facility or within 50 feet of the facility. Any use or appearance of being under the influence of alcohol will result in immediate termination of membership and notification of law enforcement.


*Be courteous. No profanity, unnecessary screaming/grunting, and/or excessive or loud cel phone use/conversations are permitted. Music, ring tones, videos or other forms of personal entertainment or communication that may be offensive will not be tolerated. Personal entertainment devices must be audible only to the individual using said device. Televisions provided by FFL are limited to a volume of 35. TV audio may be heard via personal listening devices by tuning to appropriate FM stations. Racist, sexist, religiously-biased, vulgar or any other potentially offensive conversations, remarks, signs, clothing, etc. will result in immediate termination of membership. All members and staff are to be treated with common courtesy and respect. Bullying, teasing, threatening, or any other form of disrespect will not be tolerated. Raising your voice at others, directing profanity towards others, or any other form of verbal abuse will not be tolerated. Touching, poking, kicking, punching, slapping, or any other form of physical interaction or abuse towards others will not be tolerated. FFL staff will not be treated with disrespect at any time.
FFL staff members on duty have the authority to remove any member from the facility at any time for any reason. Any complaints concerning staff are to be submitted in writing. Anyone violating these policies will immediately have their membership terminated and/or may have charges filed. FFL reserves the right to determine violation of any policy. FFL reserves the right to define appropriate behavior.
*Wipe down equipment after use. Sanitary wipes are available for your use. To help prevent illness, please wipe down all equipment immediately after use, including pads, handles, grips, and pins. This includes, but is not limited to, cardio machines, circuit machines and attachments,
classroom equipment, balls, mats, and free weight benches, bars, plates, and dumbbells. Those using our tanning equipment, locker room benches, and sauna are required to wipe down all surface areas that come in contact with any part of user’s body.


*Trash cans and recycle bins are readily available.
All members must dispose of personal trash, including used equipment wipes, prior to leaving any area of the facility.

*Go Green. Please turn off lights, TVs, fans, etc. after use. Members may not attempt to adjust A/C, computers/speakers, or other equipment. Attempting to adjust or otherwise tamper with any equipment may result in loss of 24-hour access, termination of membership, and/or charges being filed.

*FFL offers no refunds. If you are dissatisfied, FFL will strive to rectify the situation. FFL reserves the right to refuse refunds for any reason on any product or service.

*Emergencies: In the event of an emergency, all persons should call 911. FFL does provide panic buttons, a small first aid kit, and an AED in the facility. These panic buttons, first aid kit, and AED should not be relied upon for emergencies, and FFL is not liable for the use and/or non-use
of this equipment. All persons should call 911 in any emergency.

Fit For Life reserves the right to interpret all policies and adherence to said policies. FFL reserves the right to change policies at any time, for any reason, without notice.

Julie Green Enterprises, LLC DBA Fit For Life reserves the right for our staff to determine whether any policy is being violated. Violation of any policy will result in immediate loss of 24 hour access and may result in termination of membership.
